While Directive (EU) 2023/2673 is primarily associated with financial services, it also introduces amendments to consumer protection rules that affect businesses concluding contracts online.
For e-commerce businesses, this means providing consumers with the ability to submit a withdrawal request directly through the store’s online interface. The purpose of the new rules is to ensure that withdrawing from a contract is as easy as entering into one.

The right to withdraw from a distance contract is not new. Consumers have long been entitled to withdraw from eligible purchases within 14 days without providing a reason.
What changes is the way this right must be exercised.
The new Article 11a of Directive 2011/83/EU requires traders to provide a functionality that allows consumers to submit a withdrawal statement directly through the trader’s website or application. This functionality must be easily accessible, clearly visible, and available throughout the period during which the consumer can exercise the right of withdrawal.
In practice, this means that online stores should not rely solely on:
- an email address,
- a downloadable PDF form,
- information contained only in the terms and conditions.
Consumers should be able to submit their withdrawal statement directly through the store’s online interface.
What should the ‘cancel order’ button look like under EU Directive 2023/2673?
The directive specifies that the functionality should be clearly labeled with wording such as “Withdraw from Contract Here” or another equally unambiguous phrase.
After entering the required information, the consumer should be presented with a separate confirmation step, for example a button labeled “Confirm Withdrawal”.
The trader must then promptly provide the consumer with confirmation of receipt of the withdrawal statement on a durable medium, including the date and time of submission. In most cases, this will be delivered by email.
Does WooCommerce comply with the requirements of EU Directive 2023/2673?
Most e-commerce platforms do not currently include a built-in feature that fully satisfies all requirements introduced by the new legislation.
Today, many online stores still handle withdrawals through:
- contact forms,
- email requests,
- downloadable PDF forms,
- third-party return management systems.
However, not all of these methods provide:
- an easily accessible withdrawal interface,
- the ability to submit a withdrawal statement online,
- automatic recording of the submission date and time,
- immediate confirmation on a durable medium.
As a result, many store owners are already evaluating what technical and procedural changes may be required before June 2026.
How Can Online Stores Prepare?
The most practical solution is a dedicated withdrawal form integrated directly with the store’s order management system.
Such a solution allows customers to:
- enter their order number,
- verify their email address,
- select products covered by the withdrawal,
- submit the withdrawal statement online,
- receive automatic confirmation of submission.
This approach not only helps businesses comply with the upcoming requirements but also streamlines customer service operations.
What are the potential consequences of failing to implement EU Directive 2023/2673?
From 19 June 2026, the absence of an appropriate mechanism for submitting a notice of withdrawal from a contract may result not only in organisational problems, but also in a real legal risk for the owner of an online shop.
In the event of a breach of consumer rights, supervisory authorities, including the Office of Competition and Consumer Protection (UOKiK), may impose financial penalties of up to 10% of the trader’s annual turnover. Sanctions may apply both to the lack of the required functionality and to the use of measures that make it difficult for the customer to exercise their right to withdraw from the contract.
However, this is not the only risk.
If the consumer has not been properly informed of their right to withdraw from the contract, the return period may be extended from the statutory 14 days to as long as 12 months. This means that returns may be accepted long after the standard return period has expired, which can generate additional costs and lead to disputes with customers.
